THE LEGAL THEORY FOR A BARACK OBAMA VICE PRESIDENCY
Inserting Barack Obama back into the White House will hinge on legislative interpretation of the twenty second and twelfth amendments to the U.S. Constitution.
The Twenty Second Amendment, enacted after Franklin Roosevelt ran his multi-term, Soviet Friendly Military dictatorship on U.S. soil, handing half of Europe to communists, could potentially allow Barack Obama to serve two more years in the White House, according to the theory.
For example, a Vice President, being elevated to the office of President, does so with less than two years remaining in the term. In such a scenario, he may in theory serve for another year and eleven months and 30 days, bringing his total to just shy of ten years total served as president, the theory says.
The 22nd Amendment reads as follows:
No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of President more than once.
Constitutional scholars argue that it is abundantly clear that this theory is wildly unconstitutional, and that it entirely violates the spirit of the 22nd Amendment, the 12th Amendment, and Article 2 Section 1, Clause 5 of the U.S. Constitution.
They posit that the Twelfth Amendment bars Obama from serving another day in the White House — and that seems fairly clear.
The 12th Amendment reads, in part:
no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.
Proponents of the Obama Plan such as University of Georgia professor of constitutional law Dan Coenen will merely toss aside the 12th amendment in order to justify their claim that Barack Obama can be Vice President again.
Liberal legal scholars such as Coenen will further abuse the Constitution to allow Barack Hussein Obama to be allowed to serve another partial — or even full term.
Democrat apparatchiks in the legal community and judiciary will also point to Article 2 Section 1 of the U.S. Constitution, which lays out qualifications for a candidate to be vice president.
These pundits will point to the idea that Article 2 Section 1 does not specifically prohibit a former president from serving in the Executive Branch as Vice President.
Speculation has run rampant during the last three-plus years that Joe Biden could well be replaced as the Democrat nominee as his administration has seen key metrics of American success falter across the board.
That speculation has reached hyperdrive in the days following Biden’s disastrous debate performance.
