“Musk can express his personal and political opinions, that is his right, but if you have a platform it must operate within the legal framework,” a European Commission spokesperson referred to the Digital Services Act (DSA).

The Commission does not want to make any statements about the livestream itself. “Nothing in the DSA prohibits the owner of a platform from hosting a livestream and expressing their opinion. But we will look at the systemic risks that such a livestream may entail.” This includes, for example, excessively boosting that livestream. A user must also always have the option not to see certain content on a platform.

The Commission has already opened an investigation into X in December 2023 in the context of the DSA. Earlier, it had already expressed concern about content moderation on the social network in the run-up to the European elections.
